5. Planning & Regulatory Approvals
Construction projects may require approvals from:

- other regulatory authorities
Unless expressly agreed in writing, obtaining these approvals remains the responsibility of the property owner.
We do not guarantee approval outcomes or approval timeframes.
6. Scope of Services
The scope of work will be described in the relevant quotation, proposal, building contract, or specification.
Any work outside the agreed scope may constitute a variation and may result in additional costs or revised completion dates.
7. Site Conditions
Construction pricing assumes site conditions consistent with the information available before work commences.
If previously undisclosed or latent conditions are discovered, including:
- rock excavation
- contaminated soil
- asbestos or hazardous materials
- concealed structural defects
- underground services
- unstable ground
- water ingress
- termite damage
additional work and costs may be required.
8. Variations
Variations may arise due to:
- client requests
- engineering requirements
- regulatory authority directions
- latent site conditions
- material substitutions
Where reasonably practicable, variations will be documented and approved before additional work proceeds.
Variations may affect pricing and project completion time.
9. Project Timeframes
Estimated commencement and completion dates are indicative only.
Project schedules may be affected by:
- weather
- authority approvals
- engineering changes
- supply chain disruptions
- labour shortages
- industrial action
- force majeure events
We are not liable for delays outside our reasonable control.
10. Payments
Payment terms will be outlined in the applicable quotation, invoice, or building contract.
Unless otherwise agreed:
- deposits may be required
- progress payments may apply
- final payment is due in accordance with the agreed payment schedule
All prices are in Australian Dollars (AUD) and include GST unless otherwise stated.
Late payments may incur reasonable interest or recovery costs where permitted by law.
11. Warranties
We provide workmanship in accordance with applicable Australian legislation and recognised industry standards.
Where applicable, statutory warranties under relevant building legislation continue to apply.
This warranty does not cover:
- normal wear and tear
- owner modifications after completion
- damage caused by third parties
- lack of maintenance
- defects unrelated to our work
Manufacturer warranties apply separately to products and materials supplied by third parties.
12. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights or consumer guarantees that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL).
Where residential building work is undertaken, applicable statutory warranties under relevant State or Territory building legislation will also apply.
13. Limitation of Liability
To the maximum extent permitted by law, we are not liable for:
- indirect or consequential loss
- loss of profits
- delays caused by authorities or third parties
- approval refusals
- latent site conditions
- project delays outside our reasonable control
Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

All content on this website, including text, images, plans, graphics, logos, branding, and website design, is owned by or licensed to HP Constructions.
